The question to the attorney was “Are we ok (Legally) if we do not show financials and corporate documents to residents that have not paid dues and/or non owners in the neighborhood?”
Answer is :
“Under § 209.005 of the Texas Property Code, an Association shall make the books and records, including the financial records, open to and reasonably available for examination by an owner, whether or not they are in good standing, but only if the owner submits a written request for the information by certified mail.
The way you are doing it is totally legal, unless an owner submits a written request via certified mail to review the financials. Then, and only then, would you need to produce them.”
